The Minister of Construction has promulgated Thông tư 63/2025/TT-BXD guiding Article 23 of Nghị định 105/2025/NĐ-CP, which provides detailed guidance on the Law on Fire Prevention and Fighting within the scope of state management of the Ministry of Construction. The Circular sets out, among other matters, the authority to issue circulation licenses for fire-resistant and fire-preventive materials and components.

Authority to Issue Circulation Licenses for Fire-Resistant and Fire-Preventive Materials and Components.
The authority to grant circulation licenses for fire-resistant and fire-preventive materials and components is prescribed as follows:
The People’s Committees of provinces and centrally governed cities assign their local construction authorities to carry out the issuance of circulation licenses for fire-resistant and fire-preventive materials and components.
The issuance of circulation licenses must comply with Article 23 of Nghị định 105/2025/NĐ-CP and other relevant legal regulations.
Thông tư 63/2025/TT-BXD takes effect from February 16, 2026.
Pursuant to Nghị định 105/2025/NĐ-CP, the application dossier for a circulation license for fire prevention, firefighting, rescue and salvage equipment, as well as fire-resistant and fire-preventive materials and components, includes:
(1) For domestically manufactured or assembled products:
An application form for a circulation license (Form No. PC20 issued together with Nghị định 105/2025);
Testing results demonstrating conformity with the declared applicable standards and relevant technical regulations, issued by a conformity assessment organization authorized to conduct product quality testing in accordance with the laws on product and goods quality and on standards and technical regulations;
Factory release certificate;
Technical documentation of the equipment, materials, or components (if any).

(2) For imported products:
An application form for a circulation license (Form No. PC20 issued together with Nghị định 105/2025/NĐ-CP);
A quality certificate and testing results demonstrating compliance with the standards and technical regulations specified in Clause 2, Article 44 of the Law on Fire Prevention, Firefighting and Rescue, issued by a foreign testing organization accredited in accordance with ISO/IEC 17025 and holding a valid accreditation certificate;
Certificate of origin;
Technical documentation of the equipment, materials, or components (if any).
In the absence of testing results issued by a qualified foreign testing organization, the enterprise may use testing results provided by a Vietnamese conformity assessment organization in accordance with the laws on product and goods quality and on standards and technical regulations.
(3) Form of application:
The application dossier for a circulation license may be submitted electronically or in hard copy. For hard copy submissions, documents must be originals or copies presented together with the originals for verification.
Where the information and documents specified in items (1) and (2) have already been connected, shared, or updated in the national database or specialized databases, the competent authority must access and use such data online for processing and may not require organizations or individuals to resubmit paper documents.
