On April 23, 2026, the 16th National Assembly passed the 2026 Law on Access to Information (Law No. 01/2026/QH16), which includes provisions on categories of information that citizens are not allowed to access from September 1, 2026.

Information Citizens Are Not Allowed to Access from September 1, 2026

Accordingly, under Article 15 of the 2026 Law on Access to Information, the categories of information that citizens are not allowed to access include:

  • Information classified as state secrets in accordance with the law on protection of state secrets;
  • Information relating to private life, personal secrets, and family secrets, except where such information may be accessed with the consent of the individual concerned or family members;
  • Trade secrets in accordance with intellectual property laws, except where information relating to trade secrets may be accessed with the consent of the owner of such trade secrets;
  • Information which, if disclosed, would harm the interests of the State, affect national defense, national security, foreign affairs, social order and safety, social ethics, public health, or harm the life, health, lawful rights and interests, or property of agencies, organizations, or other individuals;
  • Information classified as work-related confidential information as determined by agencies or units in accordance with the law;
  • Information relating to internal meetings of agencies or units, and documents prepared by agencies or units for internal purposes.

Under the 2016 Law on Access to Information, previous regulations mainly provided that citizens were not allowed to access information classified as state secrets in the fields of politics, national defense, national security, foreign affairs, economy, technology, and information that could harm the interests of the State. Accordingly, the 2026 Law on Access to Information additionally supplements several categories of information that citizens are not allowed to access, such as information related to the private life of individuals and families, as well as trade secrets.

In addition, Article 16 of the 2026 Law on Access to Information also stipulates information that citizens may access subject to conditions, specifically:

Information relating to private life and personal secrets may be accessed with the consent of the individual concerned. Information relating to family secrets may be accessed with the consent of family members. Access to information classified as personal data shall comply with the laws on personal data protection;

Information relating to trade secrets may be accessed with the consent of the owner of such trade secrets;

Conditional access to archival documents preserved in historical archives shall comply with the laws on archives;

In the course of performing their functions, duties, and powers, heads of agencies or units may decide to provide information relating to private life, personal secrets, personal data, family secrets, and trade secrets where necessary for the public interest or public health in accordance with relevant laws, without requiring consent.
