On January 31, 2026, the Government promulgated Decree No. 49/2026/ND-CP providing detailed guidance on the implementation of Resolution No. 254/2025/QH15. The Decree specifically stipulates the decentralization and delegation of authority to commune-level People’s Committees in the issuance of Land Use Right Certificates (Red Books).

The decentralization and delegation of authority to commune-level People’s Committees in issuing Land Use Right Certificates are detailed by the Government in Clause 2, Article 14 of Decree No. 49/2026/ND-CP as follows:
The Chairperson of the commune-level People’s Committee shall issue Land Use Right Certificates, ownership certificates for assets attached to land, or certify changes to already issued certificates in cases where the competent commune-level authority or person has decided on land allocation, land lease, permission for change of land use purpose, adjustment of land use term, extension of land use term, conversion of land use form, recognition of land use rights, or re-determination of residential land area.

In addition, under Clause 2, Article 14 of Decree No. 49/2026/ND-CP, the Government also provides for the authority to issue Land Use Right Certificates, ownership certificates for assets attached to land, to certify changes to issued certificates, and to correct, revoke, or cancel issued certificates for certain other authorities as follows:
The provincial-level land administration authority shall issue Land Use Right Certificates and ownership certificates for assets attached to land, or certify changes to issued certificates, in cases where the competent provincial-level authority or person has decided on land allocation, land lease, permission for change of land use purpose, adjustment of land use term, extension of land use term, conversion of land use form, or recognition of land use rights;
The Land Registration Office shall issue Land Use Right Certificates and ownership certificates for assets attached to land, certify changes to issued certificates, or carry out initial land registration and registration of changes in cases not falling under Points a and b, Clause 2, Article 14 of Decree No. 49/2026/ND-CP;
The authorities competent to issue Land Use Right Certificates and ownership certificates for assets attached to land as prescribed in Points a, b, and c, Clause 2, Article 14 of Decree No. 49/2026/ND-CP shall also have the authority to correct errors in issued certificates; revoke or cancel issued certificates; and re-issue Land Use Right Certificates and ownership certificates for assets attached to land.
