Pursuant to Article 86 of the Law on Handling of Administrative Violations 2012, amended by Clause 43, Article 1 of the Law on Handling of Administrative Violations, Amended 2020 stipulates the case when the time limit for implementing a decision to sanction a traffic violation expires without If an individual still fails to perform his/her obligations, he/she may be forced to enforce the penalty decision in the following forms:
- Deduct part of salary or part of income, deduct money from the account of the violating individual or organization;
- Distraint of assets with a value corresponding to the fine amount for auction;
- Collect money and other assets from subjects forced to execute administrative penalty decisions held by other individuals or organizations in cases where individuals or organizations intentionally disperse assets after committing violations.
- Forced implementation of remedial measures.
Pursuant to Article 11 of Decree 166/2013/ND-CP stipulating that part of salary or part of income can be deducted many times, the rate is as follows:
- For salary and social insurance, the deduction rate must not exceed 30% of the total salary and social insurance each time.
- For other income, the deduction rate must not exceed 50% of total income each time.
Thus, in 2025, if an individual who commits a traffic violation intentionally does not pay the fine and leaves the vehicle behind, he or she will still have to pay the fine according to the administrative penalty decision. If he or she does not accept the penalty decision, he or she may be subject to enforcement.
In addition, based on Clause 4, Article 126 of the Law on Handling of Administrative Violations 2012, amended by Point b, Clause 65, Article 1 of the Law on Handling of Administrative Violations, Amended 2020 regulates the handling of vehicle traffic violations. If the violator, owner, manager or legal user does not come to receive the violator at the end of the temporary detention period, within 01 month from the date of the second notification, the violator, owner, manager or legal user will not come to receive it. Within 05 working days, the competent person must issue a decision to confiscate evidence and means of administrative violations.
