According to Article 5 of Circular 16/2023/TT-BCT, the term of the contract is agreed upon by both parties. In case the two parties do not specifically agree on the term of the contract, the term of the contract is calculated from the date of signing to the date of contract termination according to the provisions of law.
However, if electricity purchase contracts for domestic purposes were signed before October 16, 2023, they will continue to be implemented until the expiration date stated in the contract.
In case either party or both parties wish to re-sign the contract before the deadline, the two parties shall consider and agree to re-sign the contract. The re-signing of the contract is carried out in accordance with the provisions of Circular 16/2023/TT-BCT.

To sign an electricity purchase contract for domestic purposes, the parties must meet the following conditions:
- The electricity purchaser must have full civil act capacity as prescribed by law, have an application for electricity purchase and information on the household's residence at the electricity purchase location or papers proving the ownership and management of electricity. management and use of electricity purchase locations;
- The electricity seller has a distribution grid capable of providing electricity to meet the electricity buyer's needs.
Thus, according to Circular 16/2023/TT-BCT, the term of the contract is agreed upon by both parties. Circular 16/2023/TT-BCT takes effect from October 16, 2023 and replaces Circular 19/2014/TT-BCT dated June 18, 2014 and Circular 38/2022/TT-BCT dated December 30, 2022.
