The 2024 Notarization Law consists of 08 Chapters and 76 Articles promulgated by the National Assembly on November 26, 2024, with outstanding new points, including regulations on the implementation of electronic notarization from July 1, 2025, aimed at establishing a legal basis for digital transformation in notarization activities.

Accordingly, there will be 02 forms of electronic notarization from July 1, 2025, including:
- Direct electronic notarization: The person requesting notarization concludes the transaction before the notary, then the notary and the notary practice organization authenticate the transaction using a digital signature to generate an electronic notarized document.
- Online electronic notarization: This form is applicable when the parties participating in the transaction request notarization but are not present at the same location and enter into the transaction via an online method under the direct presence of the notary. The notary and the notary practice organization authenticate the transaction using a digital signature to generate an electronic notarized document.
The scope of transactions applicable to electronic notarization from July 1, 2025 is as follows:
- Direct electronic notarization shall apply to all civil transactions.
- Online electronic notarization shall apply to civil transactions, except for wills and other unilateral legal civil transactions.
- Diplomatic missions shall perform electronic notarization for transactions as prescribed in Clause 1, Article 73 of the 2024 Notarization Law.
Conditions for using electronic notarization services
1. Participants in electronic notary transactions use public digital signatures issued by Vietnamese organizations providing public digital signature certification services in accordance with Vietnamese law or foreign digital signatures and digital signature certificates recognized in Vietnam, unless otherwise provided by law.
2. Organizations and individuals participating in electronic notarization may register for an account to use electronic notarization services on the electronic notarization platform or be authenticated to issue digital signature certificates via the VNeID application or other applications at the time of participating in the transaction to synchronize accounts and issue digital signature certificates in accordance with the law. Notaries and notary organizations are obliged to guide organizations and individuals to register accounts to use electronic notarization services and comply with relevant legal provisions.
Thus, from July 1, 2025, electronic notarization will be widely applied to civil transactions, with specific scope and implementation forms depending on each type of transaction and competent entity.
The 2024 Notarization Law takes effect from July 1, 2025.
