On December 11, 2024, the Standing Committee of the National Assembly issued Ordinance No. 05/2024/UBTVQH15 on litigation costs; which clearly stipulates 08 groups of subjects exempted from advance payment of certain litigation costs from July 1, 2025.

According to Decree No. 05/2024/UBTVQH15 dated December 11, 2024, 08 groups of subjects are exempted from advance payment of on-site review and appraisal costs, advance payment of appraisal costs; exempted from on-site review and appraisal costs, appraisal costs in civil proceedings, administrative proceedings including:

(1) Children;

(2) Individuals from poor households, near-poor households;

(3) Elderly people enjoying social protection policies according to the provisions of the law on the elderly;

(4) People with disabilities enjoying social protection policies according to the provisions of the law on people with disabilities;

(5) People with meritorious services to the revolution;

(6) Ethnic minorities residing in villages and communes with especially difficult socio-economic conditions;

(7) Biological fathers, biological mothers, spouses, biological children, adopted children of martyrs, people who have contributed to raising martyrs;

(8) Agent Orange victims.

In principle, exemption and reduction of advance payment for on-site examination and appraisal costs, advance payment for appraisal costs; exemption and reduction of on-site examination and appraisal costs, appraisal costs in civil proceedings and administrative proceedings are as follows:

- Exemption and reduction of advance payment for on-site examination and appraisal costs, advance payment for appraisal costs; exemption and reduction of on-site examination and appraisal costs, appraisal costs apply to persons specified in Articles 7 and 8 of the 2024 Ordinance on Litigation Costs who have requests for on-site examination and appraisal, requests for appraisal accepted by the Court and are only exempted and reduced for on-site examination and appraisal, appraisals performed by public agencies, public service units, and public judicial appraisal organizations.

- In case the parties agree that one party shall bear all or part of the costs of on-site examination, appraisal, and appraisal costs payable, and the party bearing all or part of the costs payable is eligible for exemption or reduction, the Court shall only consider exemption or reduction for the part that the person eligible for exemption or reduction must bear according to the provisions of the Ordinance on Litigation Costs 2024. The part of the cost that that person accepts to pay on behalf of another person shall not be exempted or reduced.

- In case of exemption or reduction of advance payment for on-site examination, appraisal, advance payment for appraisal costs; exemption or reduction of on-site examination, appraisal, and appraisal costs, the agency conducting the on-site examination, appraisal, and the agency requesting the appraisal shall be responsible for paying the exempted or reduced amount.

Thus, the exemption of advance payment and costs for on-site examination, appraisal, and appraisal in civil and administrative proceedings for 08 specific groups of subjects (including children, people from poor/near-poor households, the elderly/disabled people receiving social protection policies, people with revolutionary contributions, ethnic minorities in particularly difficult areas, relatives of martyrs and people infected with Agent Orange) contributes to reducing financial burdens, creating favorable conditions for them to participate in the litigation process, protecting their legitimate rights and interests in a fairer and more effective manner. This Ordinance is an important step forward in implementing the principle of social justice in judicial activities. 

Ordinance No. 05/2024/UBTVQH15 takes effect from July 1, 2025.
