FROM JULY 01, 2025, HOUSEHOLD BUSINESSES AND COOPERATIVES SHALL BE REGISTERED WITH COMMUNE-LEVEL BUSINESS REGISTRATION AUTHORITIES
On June 11, 2025, the Government issued Decree No. 125/2025/NĐ-CP regulating the division of authority between two levels of local government in the field of state management under the Ministry of Finance, effective from July 01, 2025.

Notably, from July 1, 2025, the registration of household businesses and cooperatives will be carried out at the commune-level business registration agency, instead of the district level as before. The commune-level People's Committees shall be vested with the authority to process household business and cooperative registration procedures pursuant to Decree No. 125/2025/NĐ-CP.
According to Article 33 of Decree No. 125/2025/NĐ-CP (effective from July 1, 2025) regulating the duties and authority for household business registration:
+ The duties and authority for household business registration of the District-level Finance - Planning Department (hereinafter referred to as the district-level business registration agency) as prescribed in Articles 82, 83, 85, 87, 89, 90, 91, 92, 93, and 94 of Decree No. 01/2021/NĐ-CP dated January 4, 2021, on enterprise registration shall be performed by the commune-level business registration agency, which may be a specialized agency or administrative organization authorized by the commune-level People's Committee.
+ The commune-level business registration agency shall receive and process household business registrations as provided in Clause 1 of this Article according to the procedures stipulated in Articles 82, 83, 85, 87, 89, 90, 91, 92, 93, and 94 of Decree No. 01/2021/NĐ-CP.
Responsibilities of business registration agencies at all levels in household business registration are specified in Article 34 of Decree 125/2025/NĐ-CP:
+ The duties and powers of the provincial-level business registration agency over the district-level business registration agency as prescribed in Clauses 2 and 7 of Article 15 of Decree No. 01/2021/NĐ-CP shall be implemented by the commune-level business registration agency.
+ The duties and powers of the district-level business registration agency as prescribed in Article 16 of Decree No. 01/2021/NĐ-CP shall be implemented by the commune-level business registration agency.
In addition, duties and authority for the registration of cooperative groups, cooperatives, and cooperative unions are regulated in Article 35 of Decree No. 125/2025/NĐ-CP:
+ Duties and authority for the registration of cooperative groups, cooperatives, and cooperative unions of the district-level business registration agency are defined in Articles 10, 11, 13, 14, 15, 18–28, 31–33, 36–37, 39, 41–50, and 51–56, 58–65 of Decree No. 92/2024/NĐ-CP dated July 18, 2024, of the Government on registration of cooperative groups, cooperatives, and cooperative unions, and shall be carried out by the commune-level business registration agency.
+ The commune-level business registration agency shall receive and process the registration of cooperative groups, cooperatives, and cooperative unions as stipulated in Clause 1, Article 35, following the procedures provided in the respective articles of Decree No. 92/2024/NĐ-CP.
Additionally, responsibilities, duties, and powers of related authorities in the registration of cooperative groups, cooperatives, and cooperative unions are also provided in Decree 125/2025/NĐ-CP, specifically in Article 36:
+ The duties and powers of the provincial-level business registration agency over the district-level business registration agency under Clauses 1 and 2 of Article 6 of Decree No. 92/2024/NĐ-CP shall apply to the commune-level business registration agency.
+ The responsibilities of state management agencies regarding registration of cooperative groups, cooperatives, and cooperative unions over the district-level business registration agency under Clauses 1 and 4 of Article 8 of Decree No. 92/2024/NĐ-CP shall apply to the commune-level business registration agency.
Thus, from July 1, 2025, the commune-level business registration agency is empowered to receive and process the registration of household businesses and cooperatives. Decree 125/2025/NĐ-CP marks a significant transition in the decentralization of state administrative management in business registration, specifically by delegating authority to the commune-level agency instead of the district level for several activities related to household businesses and cooperatives. This transition establishes a clear new role and legal responsibility of commune-level authorities in the overall process of household business registration and information management.
