As of July 1, 2025, employees whose labor contracts are temporarily suspended may participate in voluntary social insurance, marking a significant advancement in social security policy and ensuring the continuous protection of employees’ rights.

Pursuant to the Social Insurance Law of 2014, individuals eligible to participate in voluntary social insurance are Vietnamese citizens aged 15 or older who are not subject to mandatory social insurance.
However, from July 1, 2025, under the provisions of the Social Insurance Law of 2024, the scope of individuals eligible to participate in voluntary social insurance includes:
- Vietnamese citizens aged 15 or older who are not subject to mandatory social insurance and are not receiving pensions, social insurance benefits, or monthly allowances.
- Employees working under indefinite-term labor contracts, fixed-term labor contracts with a duration of one month or more, including cases where the employee and employer agree to a different designation but the content reflects paid employment, wages, and management, administration, or supervision by one party, as well as cadres, civil servants, and public employees whose labor contracts or working contracts are temporarily suspended, except where both parties have an agreement on mandatory social insurance contributions during this period.
Thus, during the period of temporary suspension of a labor contract, if the parties do not agree to continue mandatory social insurance contributions, the employee may participate in voluntary social insurance during this time.
The Social Insurance Law of 2024 takes effect on July 1, 2025.
