In the draft Decree regulating penalties for administrative violations in the field of land under the Land Law 2024, drafted by the Ministry of Natural Resources and Environment, the issue of increasing fines for individuals who do not register land changes belt was proposed. This draft Decree is expected to replace Decree 91/2019/ND-CP dated November 19, 2019 of the Government on sanctioning administrative violations in the field of land.

Specifically, the Draft Decree stipulates penalties for administrative violations in the field of land, if land change registration is not carried out in the cases in the Land Law 2024, the form and level of administrative fines for individuals who commit violations, it will be as follows:
Case 1: If within 24 months from the date of exceeding the deadline prescribed in the Land Law 2024, the change is not registered, you will be fined from 2,000,000 VND to 3,000,000 VND in agricultural areas.
For urban areas, the fine is 2 times the fine for rural areas, which is from 4,000,000 VND to 6,000,000 VND.
Case 2: If the 24-month period from the date of the deadline prescribed in the Land Law 2024 does not register changes, you will be fined from 3,000,000 VND to 5,000,000 VND in agricultural areas.
For urban areas, the fine is 2 times the fine for rural areas, which is from 6,000,000 VND to 10,000,000 VND.
Note: The above penalties will apply to individuals who commit violations. In case the violation is committed by an organization, the fine is equal to 2 times the fine for an individual.
Currently, according to Decree 91/2019/ND-CP, cases where individuals do not register land changes according to the provisions of the Land Law 2013 will have the following forms and penalties:
- If within 24 months from the date the deadline specified in the Land Law 2013 is exceeded, a fine from 1,000,000 VND to 3,000,000 VND will be imposed for rural areas; from 2,000,000 VND to 6,000,000 VND for urban areas;
- If within 24 months from the date the deadline specified in the Land Law 2013 is exceeded, a fine from 2,000,000 VND to 5,000,000 VND will be imposed for rural areas; from 4,000,000 VND to 10,000,000 VND for urban areas.
Thus, the draft Decree has increased the minimum penalty for failure to register land changes in each area.
