April 30th (Reunification Day) and May 1st (International Labor Day) are two major public holidays in Vietnam, officially designated as paid days off under the 2019 Labor Code. For the 2025 April 30th–May 1st holiday, employees nationwide will enjoy a continuous five-day break, from Wednesday (April 30th) through Sunday (May 4th). To compensate for the extended time off, employees will work an additional make-up day on Saturday, April 26th. This arrangement is intended to provide workers with a cohesive holiday period, allowing for rest, travel, and personal time.
According to Article 98 of the 2019 Labor Code, wage regulations for overtime and night work are clearly defined as follows:
- Employees who work overtime shall be paid based on the unit price of their salary or their actual wage for the work they are performing:
+ On regular working days: at least 150%;
+ On weekly rest days: at least 200%;
+ On public holidays, Tet holidays, and paid days off: at least 300%, excluding the regular daily wage if the employee is paid daily.
- Employees working during night shifts shall receive at least an additional 30% of their wage based on the unit price or actual wage for the same job performed during the day.
- Employees who work overtime during night hours shall, in addition to the wages prescribed in Clauses 1 and 2, Article 98 of the 2019 Labor Code, be entitled to an extra 20% of their wage, calculated based on the unit wage or the actual wage paid for the job performed during daytime hours on a normal working day, a weekly day off, or a public holiday or Tet holiday.
- Accordingly, for those working on April 30th and May 1st, wage entitlements are as follows:
+ Daytime work: Employees shall receive at least 400% of their normal wage (100% regular wage and 300% holiday overtime pay).
+ Nighttime work: Employees shall be entitled to at least 490% of their wage (including 100% regular wage + 300% holiday overtime pay + 30% night shift premium + 60% overtime night shift pay).

Note: Any arrangement to have employees work overtime during public holidays must comply with Article 107 of the 2019 Labor Code, which stipulates:
- Employers may only require employees to work overtime if the following conditions are met: The employee’s consent is obtained; Overtime does not exceed 50% of normal working hours per day; In cases of weekly working hour arrangements, total working time including overtime does not exceed 12 hours per day and 40 hours per month; The total annual overtime does not exceed 200 hours, except for certain special cases which allow up to 300 hours/year.
- The professions and industries eligible for the 300-hour annual overtime cap include: textile and garment manufacturing, leather and footwear, electronics, agricultural/forestry/fishery processing, electricity and water supply, telecommunications, and highly skilled or urgent work due to unforeseen events such as natural disasters or technical emergencies.
- In cases where overtime exceeds 200 hours per year, the enterprise must provide written notification to the labor authority under the Provincial People's Committee.
In conclusion, employees working on April 30th and May 1st must be compensated by statutory wage regulations. Employers must ensure not only proper payment but also compliance with legal provisions on working hours and overtime conditions.
