On March 7, 2025, the Minister of Education and Training issued Circular 05/2025/TT-BGDĐT, effective from April 22, 2025, regulating the working regime for teachers in general education and preparatory universities. This includes provisions on duties, working time, annual leave, teaching hour norms, reduction of teaching hour norms, and conversion of other activities into teaching hours.

According to Article 5 of Circular 05/2025/TT-BGDĐT:

- The working time during the academic year for principals, vice-principals, and teachers in general education schools is 42 weeks, including:​

+ 37 weeks for teaching the contents of the general education program (comprising 35 weeks of actual teaching and 2 reserve weeks);​

+ 3 weeks for studying and improving professional qualifications;​

+ 2 weeks for preparing for the new academic year and summarizing the academic year. ​

Article 6 of Circular 05/2025/TT-BGDĐT stipulates the annual leave time for teachers as follows:

- Summer vacation time as prescribed in point a, clause 1, Article 3 of Decree 84/2020/NĐ-CP dated July 17, 2020. ​

During the summer vacation, teachers participate in training and professional development as required by their job positions and engage in high school graduation exams and admissions work when summoned by competent authorities.​

- Public holidays, Tet holidays, and other leave days as prescribed by the Labor Code 2019 and the Social Insurance Law 2024.​

- Based on the academic year's plan, the scale, characteristics, and specific conditions of each school, the principal arranges the annual leave time for teachers appropriately, ensuring compliance with regulations and the academic year's timeframe. ​

Notes: In cases where the summer vacation and maternity leave of female teachers overlap, in addition to the leave prescribed in point b, clause 1, Article 6 of Circular 05/2025/TT-BGDĐT, the teacher's leave includes:​

- Maternity leave as prescribed;​

- Summer vacation time outside of maternity leave (before or after maternity leave);​

- If the summer vacation time specified in point b, clause 2, Article 6 of Circular 05/2025/TT-BGDĐT is less than the annual leave days prescribed by the Labor Code, the teacher is entitled to additional leave days. The total additional leave days and the leave days specified in point b, clause 2, Article 6 of Circular 05/2025/TT-BGDĐT equal the annual leave days prescribed by the Labor Code 2019. The additional leave time is arranged flexibly by agreement between the teacher and the principal.

In cases where male teachers take paternity leave when their wives give birth, as prescribed by the Social Insurance Law 2024, during the leave period, male teachers are considered to have fulfilled their teaching hour norms and are not required to make up for missed teaching hours. If the paternity leave coincides with the summer vacation, no additional leave is granted. ​

Thus, from April 22, 2025, the working time and annual leave of teachers will be applied according to Circular 05/2025/TT-BGDĐT with clear, detailed regulations that are suitable for the profession's characteristics. These regulations ensure teachers' rights regarding summer vacation, public holidays, and other statutory leave, contributing to enhancing teaching effectiveness and professional development.​

Circular 05/2025/TT-BGDĐT takes effect from April 22, 2025. ​
