From August 1, 2024, the Land Law 2024 clearly stipulates the cases in which land users and assets attached to the land will not be granted Red Book Certificates. Accordingly, many types of land without documents will be issued a Certificate of Land Use Rights, also known as a Red Book or Pink Book.

The issuance of Certificates of Land Use Rights, and ownership of assets attached to the land for cases where households and individuals are using land stably but do not have any of the documents on land use rights as stipulated in Article 137 of the Land Law 2024, and do not fall under the provisions of Articles 139 and 140 of the Land Law 2024, shall be carried out as follows:
1.Households and individuals using land before December 18, 1980, with confirmation from the People's Committee of the commune where the land is located that there is no dispute, shall be issued with a Certificate of Land Use Rights and ownership of assets attached to the land as follows:
a) For a land plot with residential houses and structures serving living purposes, if the land plot's area is equal to or greater than the residential land recognition limit as prescribed in Clause 5, Article 141 of this Law, the residential land area shall be recognized equal to the residential land recognition limit, and there is no requirement to pay land use fees.

2. Households and individuals using land from December 18, 1980, to before October 15, 1993, who are confirmed by the People's Committee of the commune where the land is located as having no disputes, shall be issued a Certificate of Land Use Rights and ownership of assets attached to the land as follows:
a) For land plots with residential houses and structures serving living purposes, if the area of the land plot is equal to or greater than the residential land recognition limit as specified in Clause 5, Article 141 of this Law, the residential land area shall be recognized equal to the residential land recognition limit, and there is no requirement to pay land use fees.

3. Households and individuals using land from October 15, 1993, to before July 1, 2014, who are confirmed by the People's Committee of the commune where the land is located as having no disputes, shall be issued a Certificate of Land Use Rights and ownership of assets attached to the land as follows:
a) For land plots with residential houses and structures serving living purposes, if the area of the land plot is equal to or greater than the residential land allocation limit as specified in Clause 2, Article 195, and Clause 2, Article 196 of this Law, the residential land area shall be recognized as equal to the residential land allocation limit. In cases where the area of the land with residential houses and structures serving living purposes is greater than the residential land allocation limit, the residential land area shall be recognized according to the actual area built for residential houses and structures serving living purposes.

Therefore, there will be three cases where land without documents will be granted a Red Book or Pink Book, including:
Case 1: Households and individuals using land before December 18, 1980, if confirmed by the People's Committee of the commune where the land is located as having no disputes.
Case 2: Households and individuals using land from December 18, 1980, to before October 15, 1993, if confirmed by the People's Committee of the commune where the land is located as having no disputes.
Case 3: Households and individuals using land from October 15, 1993, to before July 1, 2014, if confirmed by the People's Committee of the commune where the land is located as having no disputes.
The Land Law 2024 has detailed three time frames for considering the issuance of a Red Book or Pink Book, specifically:
Before December 18, 1980;
From December 18, 1980, to before October 15, 1993;
From October 15, 1993, to before July 1, 2014.
Note: The above three cases must meet the conditions specified in Article 138 of the Land Law 2024.
