Most types of stable, long-term, and legally used land are eligible for red book certificates. However, according to the new provisions of the Land Law 2024 effective from July 1, 2024, there are cases where red book certificates will not be issued.

The Land Law 2024, effective from July 1, 2024, stipulates 7 cases where red book certificates will not be issued:
- Agricultural land used for public purposes as prescribed in Article 179 of this Law.
- Land assigned for management under cases specified in Article 7 of this Law, except for cases where land is assigned for joint use with managed land, which will be issued a Land Use Rights Certificate, ownership rights to property attached to land for the area of land used as determined by the decision on land assignment, land lease of the competent state agency.
- Rented or subleased land by land users, except for cases of renting or subleasing land for construction business infrastructure suitable for approved investment projects by competent authorities.
- Land received by lump sum payment, except for cases recognized for land use rights under point a Clause 2 Article 181 of this Law.
- Land is subject to land recovery decisions by competent state agencies, except for cases where more than 03 years have passed from the time of the land recovery decision without implementation.
- Land in dispute, encumbered, applying other measures to ensure the enforcement of civil judgment as prescribed by law on civil judgment enforcement; land use rights subject to temporary urgent measures as prescribed by law.
- Organizations assigned land by the State without land use fees for construction of public works not for business purposes.
Additionally, the Land Law 2024 also specifies cases where property attached to land will not be granted a Red Book, such as property attached to land on parcels of land that do not meet the conditions for granting a Red Book.
Therefore, these 7 cases will not be eligible for red book certificates. Depending on your specific case, you should carefully compare to see if you fall under any of these categories. Those planning to buy land or property should absolutely avoid purchasing these types of land.
The Land Law 2024 will take effect from July 1, 2024.
