On February 5th, 2024, the Government issued Decree No. 12/2024/ND-CP amends and supplements certain provisions of Decree No. 44/2014/NĐ-CP regarding land prices and Decree No. 10/2023/NĐ-CP related to guidelines for the implementation of the Land Law. Accordingly, The new decree changes conditions for converting the land use purpose from paddy land, forest land to other land types for implementing investment projects.

Specifically, in Decree No. 12/2024/ND-CP amends conditions for the grant of permission to repurpose rice, forest land with the aim of executing investment projects:
(1) Having an investment project of which the in-principle approval is granted or having been granted with an investment registration certificate;
(2) Being compliant with the land use master plan at the district level or [the investment project]being included in the approved annual land use master plan at the district level;
(3) Having a plan on the planting of replacement forests, or a document on fulfillment of the obligation to pay for the planting of replacement forests for converting land for protection forests and land for special-use forests, or having the plan to use the topsoil and a document on fulfillment of the obligation to pay for protection and development of croplands for converting paddy land;
(4) Conducting preliminary environmental impact assessment and environmental impact assessment (if applicable);
(5) The competent authority responsible for assessing and approving the conversion of forest protection land, special-use forest land, and rice cultivation land for other purposes shall only be liable for the contents specified in Decree No. 12/2024/ND-CP; shall not be liable for other matters that have been previously assessed, approved, decided, or resolved by the competent authority.
Therefore, Decree No. 12/2024/NĐ-CP amends and supplements Decree No. 44/2014/NĐ-CP concerning conditions for grant of permission to repurpose rice, protection forest or special-use forest land with the aim of executing investment projects.
Reference to Decree No. 12/2024/NĐ-CP came into effect on February 5th, 2024.
