On June 12, 2024, the Minister of Planning and Investment issued Circular 10/2024/TT-BKHDT to amend Circular 10/2022/TT-BKHDT, which provides guidance on the provision, publication of information, and selection of investors on the National E-Procurement System. Accordingly, regulations on investor selection on the national e-procurement system have undergone some changes.

Accordingly, this circular has amended several articles of Circular No. 10/2022/TT-BKHDT dated June 15, 2022 by the Minister of Planning and Investment, which details the provision, publication of information, and selection of investors on the National E-Procurement System.
1. Repealed clauses or phrases
- Repeal the phrase "projects that must organize bidding according to specialized laws and laws on socialization" in points a and b, clause 1, Article 1;
- Repeal the phrases "project registration documents", "preliminary requirements for capacity and experience" in Articles 10 and 20;
- Repeal the phrases "the unit assigned by the competent authority for projects that must organize bidding according to specialized laws and laws on socialization"; "the unit assigned by the competent authority to evaluate projects that must organize bidding according to specialized laws and laws on socialization" in Articles 20 and 27;
- Repeal clause 3 of Article 9; point c of clause 1, point c of clause 2, and point c of clause 3 of Article 10; point b of clause 1 of Article 20.
2. Regulations on clarification, amendment, replacement, withdrawal of E-HSQT, E-HSDST, E-HSĐKTHDA, project registration documents are amended as follows:
(1) Clarification of E-HSQT, E-HSDST, E-HSĐKTHDA:
- Investors are responsible for:
+ Clarifying E-HSQT, E-HSDST, E-HSĐKTHDA as requested by the procuring entity, Project Preparation Unit or Agency, unit in charge of receiving PPP project proposal documents, Department of Planning and Investment, Economic Zone Management Board for investment projects using land;
+ Self-clarifying, supplementing documents proving legal status, capacity, experience when investors discover that E-HSQT, E-HSDST, E-HSĐKTHDA lack information or documents about their existing legal status, capacity, experience but have not been submitted with the documents.
+ The clarification of E-HSQT, E-HSDST for PPP projects, E-HSĐKTHDA for investment projects using land is carried out on the System. All requests for clarification and clarification documents from investors are carried out on the System.
(2) Amendment, replacement, withdrawal of E-HSQT, E-HSDST, E-HSĐKTHDA:
- After submission, investors can amend, replace, or withdraw E-HSQT, E-HSDST, E-HSĐKTHDA.
- After the deadline for submitting E-HSQT, E-HSDST, E-HSĐKTHDA, investors are not allowed to withdraw the submitted documents.
Thus, Circular 10/2024/TT-BKHDT has stipulated the clauses or phrases to be repealed and amended regulations on clarification, amendment, replacement, withdrawal of E-HSQT, E-HSDST, E-HSĐKTHDA, project registration documents.
Circular No. 10/2024/TT-BKHDT takes effect on July 26, 2024.
