Telecommunications Law No. 24/2023/QH15 (Telecommunications Law 2023) has been approved by the National Assembly and will take effect in 2024. The regulations of the 2023 Telecommunications Law have many new points compared to the current 2009 Telecommunications Law, act in a more comprehensive and complete direction.

According to the Telecommunications Law 2023, telecommunications licenses include telecommunications service business licenses and telecommunications professional licenses, specifically:
(1) Telecommunication service business license includes:
- A license to provide telecommunications services with network infrastructure with a term of not more than 15 years is issued to enterprises providing services with network infrastructure;
- A license to provide telecommunications services without network infrastructure with a term of not more than 10 years is issued to businesses providing services without network infrastructure.
(2) Telecommunications license includes:
- A license to install telecommunications cables at sea with a term of not more than 25 years is issued to organizations installing telecommunications cables at sea landing or passing through Vietnamese waters;
- A license to establish a private telecommunications network with a term of not more than 10 years is issued to an organization establishing a private telecommunications network;
- A license to test telecommunications networks and services with a term of not more than 02 years is issued to telecommunications enterprises to test networks and telecommunications services;
- A license to establish a telecommunications network with a term of not more than 10 years is issued to the national radio station and national television station under the Government to perform the function of information and propaganda of the Party's policies and guidelines. State policies and laws, and activities are not for profit purposes.
It can be seen that the classification of telecommunications licenses in the Telecommunications Law 2023 has had changes and additions compared to the Telecommunications Law 2009, thereby specifically regulating the conditions for granting, extending, amending and supplementing each type of telecommunications license.
The Telecommunications Law 2023 also adds regulations on forms of telecommunications licensing, according to which forms of telecommunications licensing include individual licensing and group licensing.
Another outstanding new feature of the Telecommunications Law 2023 on telecommunications licenses is the regulation on registration to provide telecommunications services. Accordingly, registering to provide telecommunications services means that an enterprise must declare information about the enterprise, the type of telecommunications services provided and meet the conditions for providing telecommunications services according to government regulations; Notice of provision of telecommunications services means an enterprise declares information about the enterprise, the type of telecommunications services provided, and information related to the quality of services that the enterprise provides.
Thus, the Telecommunications Law 2023 has many amendments and supplements to telecommunications licenses as specifically stated above.
Telecommunications Law 2023 takes effect from July 1, 2024.
