Clause 1, Article 7 of Decree 120/2013/ND-CP (amended and supplemented in Decree 37/2022/ND-CP) stipulates that citizens who are not present at the time or gathering place stated in the military call-up without a valid reason will be fined from 30,000,000 VND to 40,000,000 VND.
(1) Persons who must undergo medical examination or examination for military service; Medical examination to select reserve officers; obey orders to enlist; call for reserve officer training; orders to focus on training, drills, and inspections for mobilization and combat readiness (hereinafter abbreviated as people performing military service) but get sick or have an accident or on the way get sick or have an accident and have to be treated at a medical examination and treatment facility.
(2) Relatives of people performing military service, including: biological father and mother; father-in-law, mother-in-law or father-in-law, mother-in-law; adoptive father, adoptive mother; legal guardian; spouse; biological children or legally adopted children who are sick or have serious accidents are being treated at medical examination and treatment facilities.
(3) Relatives of people who performed military service as specified in point (2) die but have not yet held a funeral or the funeral has not yet ended.
(4) The house of a person performing military service or the house of a relative of a person performing military service specified in point (2) is located in an area affected by natural disasters, epidemics, and fires that seriously affect life.
(5) Persons performing military service do not receive a call for medical examination or examination to perform military service; Medical examination to select reserve officers; call for military service; call for reserve officer training; a call to focus on training, rehearsals, and testing for mobilization readiness and combat readiness; or have received an order, but the order does not clearly state the time or location due to the fault of the responsible person or agency, or because another person has obstructed acts as prescribed in Article 7 of Circular 07/2023/TT-BQP.
Note:
- In the cases specified in points (1), (2), there must be confirmation from the commune-level People's Committee of the place of residence or the medical examination and treatment facility that provided treatment or the commune-level medical station of the place of residence;
- In the cases specified in points (3), (4), there must be confirmation from the commune-level People's Committee of the place of residence;
- In the case specified in point (5), there must be confirmation from the commune-level People's Committee of the place of residence or a competent agency.
Thus, citizens are allowed to be absent from military service if they fall into one of the 5 cases mentioned above. However, citizens must have confirmation from the commune-level People's Committee or competent authority.
