On July 24, 2024, the Ministry of Construction issued Circular 03/2024/TT-BXD 2024 providing guidance on management councils and standards and conditions for appointment and dismissal of management council members in the unit. Pursuant to Article 5 of Circular 03/2024/TT-BXD, the structure and term of the Management Council in the construction sector are as follows:
(1) The structure of the Management Council includes:
- Representatives of the superior management agency of the public service unit, including representatives of ministries, ministerial-level agencies, agencies under the Government, organizations established by the Government, the Prime Minister that are not public service units, provincial People's Committees and direct superior management agencies (if any); working on a part-time basis;
- Head of the public service unit;
- Officials of the public service unit;
- Representatives of related organizations and units.
(2) The number of members of the Management Council is from 05 to 11 people, including the Chairman of the Management Board, the Secretary of the Management Council and the members of the Management Council.
Depending on the requirements of the tasks, the Management Council may have a Vice Chairman of the Management Council. The number and structure of members of the Management Council of each specific public service unit is decided by the head of the agency competent to approve the autonomy project of the public service unit.
The Chairman of the Management Council and members of the Management Council are selected and appointed by the head of the agency competent to approve the autonomy project of the public service unit from the leadership representative of the public service unit. public enterprise or representative of the superior management agency of the public service unit.
Vice Chairman of the Management Council (if any), Secretary of the Management Council and members of the Management Council are appointed by the head of the agency competent to approve the autonomy project of the public service unit. .
(3) The term of office of a member of the Management Council shall not exceed 05 years.
Thus, the structure and term of the Management Council in the construction sector must comply with the above regulations from September 9, 2024.
Circular 03/2024/TT-BXD takes effect from September 9, 2024.
