I. SOME IMPORTANT LEGAL ISSUES RELATED TO TEMPORARY RESIDENCE CARD
1. Conditions for issuance of temporary residence card?
According to the regulations of the immigration management agency, when foreigners want to apply for a temporary residence card in Vietnam, they must meet the following conditions for issuance of a temporary residence card in Vietnam:
(1) Passport valid for more than 1 year;
(2) Foreigners who have entered Vietnam and are residing in Vietnamese territory;
(3) Have registered for temporary residence directly at the commune or ward police station or registered online in accordance with regulations;
(4) Be eligible for temporary residence cards for foreigners;
(5) Have all legal papers and documents proving eligibility for a temporary residence card.

2. Types of temporary residence cards
A temporary residence card is a document issued by the immigration management agency or a competent agency of the Ministry of Foreign Affairs to foreigners who are allowed to reside for a period of time in Vietnam and is valid in place of a visa.
According to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam amended in 2019, there are the following types of temporary residence cards:
(1) NG3: Issued to members of diplomatic missions, consulates, United Nations representative agencies, and intergovernmental organizations in Vietnam. Husband, wife, children under 18 years old, housekeeper accompanying on term;

(3) LV2: This type of temporary residence card is issued to foreigners entering Vietnam to work with political, social organizations, social organizations, Chambers of Commerce and Industry in Vietnam;
(4) Phone: This is a type of temporary residence card issued to foreigners who are investors and do foreign trade in Vietnam:
- The symbol DT1 will be for capital contributions worth 100 billion VND or more or investments in industries, occupations with investment incentives, and investment incentive areas;

(7) DH: Foreigners entering Vietnam to practice, study, or do research will be issued a temporary residence card with the symbol DH;
(8) PV1: Issued to reporters and press who are foreigners permanently residing in Vietnam;

(1) LĐ2 – Issued to foreigners working in Vietnam who are required to have a work permit;
(2) The duration of a temporary residence card for foreigners with a work permit in Vietnam is no more than 02 years.
Question 2: How long is the temporary residence card valid for?

According to the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam 2019, the duration of temporary residence cards is prescribed as follows:
(1) The duration of the temporary residence card issued is at least 30 days shorter than the remaining validity of the passport;
(2) Temporary residence card with symbol DT1 is valid for no more than 10 years;
(3) Temporary residence cards with symbols NG3, LV1, LV2, LS, ĐT2 and DH are valid for no more than 05 years;
(4) Temporary residence cards with symbols NN1, NN2, DT3, TT are valid for no more than 03 years;
(5) Temporary residence cards with symbols LD1, LD2 and PV1 are valid for no more than 02 years;
(6) Expired temporary residence cards will be considered for issuance of new cards.
