On May 16, 2024, the Government issued Decree No. 54/2024/NĐ-CP regulating the drilling of groundwater, declaration, registration, licensing, water resource services, and upfront payment for water resource exploitation rights. Accordingly, the new Decree amends the dossier for application for granting or extending surface water and seawater exploitation licenses.

Specifically, Decree No. 54/2024/NĐ-CP stipulates the components of the dossier for requesting issuance or extension of permits for surface water and seawater exploitation as follows:
(1) Dossier for requesting issuance of permits for surface water and seawater exploitation:
- Permit application form;
- Water exploitation plan;
- Location diagram of water exploitation facilities.
Water quality analysis results conducted within a maximum period of 6 months prior to the submission date of the dossier, instead of the usual 3-month period stipulated in the current Decree No. 02/2023/NĐ-CP.
Except for seawater exploitation; surface water exploitation for purposes such as hydropower, machinery cooling, equipment cooling, steam generation, heating, salinity prevention, water source creation, flood prevention, landscape creation, and construction projects.
Additional minimum parameters for the analysis results include: pH, BOD5, COD, TSS, DO, Total phosphorus, Total nitrogen, Total Coliform, Chloride.
The analysis results must be conducted by organizations meeting the legal requirements and conditions for environmental monitoring capacity.
(2) Dossier for requesting extension of permits for surface water and seawater exploitation:
- Application for permit extension/adjustment;
- Utilization of the water exploitation plan and the implementation status of the permit instead of the current requirement for a report on the current status of water exploitation and use;
- Location diagram of water exploitation works, except in cases of extending permits for surface water and seawater exploitation.
The forms and contents of the plans as mentioned above shall be prepared according to the Templates in the Appendices attached to Decree No. 54/2024/NĐ-CP.
For irrigation works constructed and exploited before January 1, 2023, the content of the plan shall be prepared according to Template No. 44 in the Appendix of Decree No. 54/2024/NĐ-CP when preparing the dossier for permit issuance.
Therefore, Decree No. 54/2024/NĐ-CP provides detailed regulations on the dossier for application for granting or extending surface water and seawater exploitation licenses.
Reference to Decree No. 54/2024/NĐ-CP will take effect from July 1, 2024.
