On 15 November 2025, the Minister of Science and Technology signed and promulgated Circular No. 34/2025/TT-BKHCN, providing regulations on digital technology products and services eligible for preferential treatment in contractor selection for the leasing and procurement of digital technology products and services using state budget funds.

Accordingly, the specific regulations applicable to hardware products eligible for preferential treatment in contractor selection for the leasing and procurement of digital technology products and services using state budget funds from 1 January 2026 are as follows:
For a hardware product to be eligible for preferential treatment, it must simultaneously satisfy the following two conditions:
(1) The hardware product design (including requirement specifications, system architecture, detailed design, schematic diagrams, printed circuit board layout, semiconductor integrated circuit layout design, and other relevant technical documents) must be owned by a Vietnamese organization or enterprise, or by an individual who is a Vietnamese citizen. Such ownership shall be established through: self-performance of the design activities; or engagement of other parties, including Vietnamese individuals, to perform the design; or acquisition of the design from other entities.
(2) The trademark affixed to the hardware product must be owned by a Vietnamese organization or enterprise, or by an individual who is a Vietnamese citizen.

Vietnamese organizations or enterprises, or individuals who are Vietnamese citizens, shall prove their ownership of the hardware design referred to in Clause 1 of this Article by one of the following documents:
+ A Patent Certificate, Utility Solution Patent Certificate, Industrial Design Patent Certificate, or Certificate of Registration of Semiconductor Integrated Circuit Layout Design issued by the competent state authority of Vietnam or by a competent foreign authority;
+ A Certificate of Copyright Registration issued by the state authority in charge of copyright and related rights;
+ Other documents evidencing ownership of objects of industrial property rights and copyright in accordance with the law.

Vietnamese organizations or enterprises, or individuals who are Vietnamese citizens, shall prove their ownership of the trademark referred to in Clause 1 of this Article by one of the following documents:
+ A Trademark Registration Certificate issued by the competent state authority in charge of industrial property rights;
+ A Decision on acceptance of protection of an international trademark registration in Vietnam;
+ Other lawful documents evidencing trademark ownership in accordance with intellectual property law.
