From November 20, 2022, Circular No. 61/2022/TT-BTC promulgated by the Minister of Finance on October 5, 2022 will take effect. It guides the production of estimates, use, payment, and finalization of expenditure on compensation, support, and relocation in case of land expropriation by the State.
According to this Circular, with respect to projects and sub-projects in areas with difficult or extremely economic-social conditions the funding level for organizing compensation, support, resettlement, and enforcement the tallies (if any) will be based on the actual workload according to the estimate approved by the competent state agency.

For projects and sub-projects that do not fall into the above case and are not subject to enforcement, the funding level for compensation, support, and resettlement must not exceed 2% of the total compensation and support funding, subsidy and resettlement.
In contrast, projects and sub-projects that do not fall into the category of implementation in difficult or extremely economic-social conditions must carry out a coercive tally according to the agency's decision, the competent state, the amount of funding to ensure the organization of compensation, support, and resettlement (excluding the funding for implementing the tally) must not exceed 2% of the total funding for compensation, support, and resettlement of the project or sub-project.

In addition, for projects and sub-projects subject to enforcement of land recovery under a decision of a competent state agency, the level of funding to ensure the organization of enforcement of land recovery is determined by the decision of a competent state agency based on the actual workload according to the estimate approved by the competent state agency as prescribed in Clause 1, Article 7 of Circular 61/2022/TT-BTC.
