Accordingly, the cases where water resource exploitation and usage projects must be registered include:

- Reservoirs, irrigation dams with a total capacity of 0.01 - 0.2 million m3, or other surface water exploitation and usage projects for agricultural production or aquaculture (excluding other projects requiring licensing) with an exploitation flow rate greater than 0.1 - 0.5 m3/second;
For reservoirs, irrigation dams with a total capacity of 0.01 million m3 to 0.2 million m3 that have exploitation and usage purposes requiring licensing, registration must be carried out according to regulations.
- Exploitation and usage of seawater for production activities on land, including aquaculture, business, and services, with a scale of over 10,000 - 100,000 m3 per day and night;
- Exploitation and usage of groundwater in cases specified in point a, Clause 2, Article 16 of Decree 02/2023/NĐ-CP and cases specified in point a, point d, Clause 1, Article 44 of the Water Resources Law 2012 in the list of areas with restricted groundwater exploitation announced by the provincial People's Committee;
- Usage of natural groundwater in mineral exploitation without causing a lowering of the groundwater level or pumping water to dry up the natural groundwater flowing into the mineral exploitation site.
Decree 02/2023/NĐ-CP takes effect from March 20, 2023.
