The Ministry of Industry and Trade has just issued Circular 31/2022/TT-BCT dated November 8, 2022, amending Circular 57/2014/TT-BCT stipulating the method and order of formulating and promulgating the electricity generation price bracket and Circular 57/2020/TT-BCT stipulating methods for determining electricity generation prices and power purchase and sale contracts.

Circular 31/2022/TT-BCT amending and supplementing regulations on power purchase and sale contract prices to compare with the base year electricity price bracket of Circular 57/2020/TT-BCT. Accordingly, the electricity purchase and sale contract price in comparison with the base year electricity generation price bracket is regulated as follows:
- PPA price must be within price range for electricity generation in the base year of power plants issued by Minister of Industry and Trade, in which, PPA price of thermal power plants for comparing with price range for electricity generation in the base year shall be calculated on the basis of cost components corresponding to cost components serving calculation of price range for electricity generation;
- In case the base year of a thermal power plant lacks electricity generation price range, PPA price of the thermal power plant shall be calculated on the basis of corresponding cost components in order to compare with electricity generation price range of the latest year applied to the power plant;
- In case projects have commenced without entering into PPA before the effective date hereof: PPA price must vary within electricity price range in the PPA negotiation year, in which PPA price of thermal power plants for the purpose of comparing with electricity generation price range shall be calculated on the basis of cost components corresponding to cost components serving calculation of electricity generation price range.

Thus, compared with Circular 57/2020/TT-BCT, Circular 31/2022/TT-BCT has added the case that: The base year of a thermal power plant does not have a price bracket for electricity generation and in the case of projects that have started but have not signed a power purchase agreement before December 28, 2022.
Circular 31/2022/TT-BCT takes effect from December 28, 2022.
