On September 23, 2025, the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, the Minister of Public Security, and the Minister of National Defense jointly issued Circular 02/2025/TTLT-TANDTC-VKSNDTC-BCA-BQP stipulating a number of procedures for reviewing death sentences before execution.

Accordingly, from November 15, 2025, the death sentence will be executed in one of the following cases:
- The person sentenced to death has no petition for clemency of the death penalty; The Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy has issued a Decision not to appeal the death sentence;
- The person sentenced to death has no petition for clemency of the death penalty; The Council of Judges of the Supreme People's Court decides not to accept the appeal for review or retrial, upholding the death sentence and the person sentenced to death still has no petition for clemency of the death penalty;
- The person sentenced to death has a petition for clemency of the death penalty; The Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy has issued a Decision not to appeal the death sentence and the Office of the President has issued a Notice of the absence of a decision of clemency by the President;
- The person sentenced to death has a petition for clemency of the death penalty; The Council of Judges of the Supreme People's Court decides not to accept the appeal for review or retrial, upholds the death sentence and the Office of the President issues a Notice of the absence of a decision on clemency by the President.
The Notice of the absence of a decision on clemency by the President is stipulated as follows:
- After 01 year from the date of receipt of the opinion of the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, if the President does not issue a decision on clemency, the Office of the President immediately issues a Notice of the absence of a decision on clemency by the President.
- The Notice of the absence of a decision on clemency by the President is sent to the Chief Justice of the Supreme People's Court, the Chief Prosecutor of the Supreme People's Procuracy, the Chief Justice of the Court that conducted the first instance trial, the Chief Prosecutor of the Procuracy at the same level as the Court that conducted the first instance trial, the detention facility for the person sentenced to death and the person sentenced to death.
- Immediately after receiving the Notice of no clemency decision from the President, the Chief Justice of the Court of First Instance shall organize the execution of the death sentence according to regulations.
