I. SOME IMPORTANT LEGAL ISSUES RELATED TO VISA TYPES FOR FOREIGNERS IN VIETNAM? WHAT ARE THE REGULATIONS FOR VISA SIGNS?
1. What is a Visa? Conditions for granting visas to foreigners in Vietnam?
According to Consolidated Document 27/VBHN-VPQH, it is stipulated: Visa is a document issued by a competent Vietnamese agency, allowing foreigners to enter Vietnam.
At the same time, Consolidated Document 27/VBHN-VPQH also stipulates the conditions for visa issuance as follows:
(1) Have a passport or valid international travel documents;
(2) There is an agency, organization or individual in Vietnam that invites or guarantees, except in cases as prescribed;
(3) Do not fall into the cases that have not been allowed to enter the country according to regulations;
Thus, when foreigners want to enter Vietnam, they must have a visa and be granted a visa when meeting the prescribed conditions, except in cases of visa exemption.

2. The regulations for visa sign
According to Consolidated Document 27/VBHN-VPQH, regulations on visa symbols are as follows:
(1) NG1 - Issued to members of the guest delegation of the General Secretary of the Central Committee of the Communist Party of Vietnam, the President, the Chairman of the National Assembly, and the Prime Minister;
(2) NG2 - Issued to members of guest delegations of the Standing Committee of the Central Committee Secretariat of the Communist Party of Vietnam, Vice President, Vice Chairman of the National Assembly, Deputy Prime Minister, Chairman of the Central Committee of the Communist Party of Vietnam. Vietnam Fatherland Front, Chief Justice of the Supreme People's Court, Director of the Supreme People's Procuracy, State Auditor General; members of the guest delegation at the same level of the Minister or equivalent, Provincial Party Secretary, City Party Secretary, Chairman of the People's Council, Chairman of the People's Committee of the province or centrally run city;
(3) NG3 - Issued to members of diplomatic missions, consular offices, representative agencies of international organizations under the United Nations, representative agencies of intergovernmental organizations and their spouses and children under 18 years old, accompanying maid on term basis;
(4) NG4 - Issued to people working with diplomatic missions, consulates, representative agencies of international organizations under the United Nations, representative agencies of intergovernmental organizations and spouses , children under 18 years old traveling together; people visiting members of diplomatic missions, consular offices, representative offices of international organizations under the United Nations, representative offices of intergovernmental organizations;
(5) LV1 - Issued to people working with departments, agencies and units directly under the Central Committee of the Communist Party of Vietnam; National Assembly, Government, Central Committee of Vietnam Fatherland Front, Supreme People's Court, Supreme People's Procuracy, State Audit, ministries, ministerial-level agencies, agencies under the Government ; Provincial Party Committee, City Party Committee, People's Council, People's Committee of provinces and centrally run cities;
(6) LV2 - Issued to people working with socio-political organizations, social organizations, Vietnam Chamber of Commerce and Industry;
(7) LS - Issued to foreign lawyers practicing in Vietnam;
(8) DT1 - Issued to foreign investors in Vietnam and representatives of foreign organizations investing in Vietnam with contributed capital worth VND 100 billion or more or investing in industries and professions with investment incentives investment incentives and areas decided by the Government;

(14) NN1 - Issued to people who are Heads of representative offices or projects of international organizations and foreign non-governmental organizations in Vietnam;
(15) NN2 - Issued to heads of representative offices, branches of foreign traders, representative offices of economic, cultural, and other foreign professional organizations in Vietnam;
(16) NN3 - Issued to people working with foreign non-governmental organizations, representative offices, branches of foreign traders, representative offices of economic, cultural organizations and other professional organizations of foreigners in Vietnam;
(17) DH - Issued to people who practice and study;
(18) HN - Issued to people attending conferences and seminars;
(19) PV1 - Issued to reporters and press residing in Vietnam;
(20) PV2 - Issued to reporters and press for short-term activities in Vietnam;
(21) LĐ1 - Issued to foreigners working in Vietnam with confirmation that they are not subject to a work permit, unless an international treaty to which Vietnam is a member has other provisions;
(22) LĐ2 - Issued to foreigners working in Vietnam who are required to have a work permit;
(23) DL - Issued to people going on vacation;
(24) TT - Issued to foreigners who are spouses and children under 18 years old of foreigners who are granted visas with symbols LV1, LV2, LS, DT1, DT2, DT3, NN1, NN2, DH, PV1, LD1 , LĐ2 or a foreigner who is a father, mother, wife, husband, or child of a Vietnamese citizen;
(25) VR - Issued to people visiting relatives or for other purposes;
(26) SQ - Issued for other cases according to regulations;
(27) EV - Electronic visa.
Thus, corresponding to the purpose of entering Vietnam, there will be different types of visas/visas with different symbols issued to foreigners.
3. Types of Visa for foreigners in Vietnam?
3.1. Tourist visa
Tourist visas are issued to foreigners who come to Vietnam for tourism purposes only, not to work in Vietnam.
However, according to regulations of Document No. 27/VBHN-VPQH, tourist visas with a term of no more than 3 months and tourist visas of more than 30 days are granted temporary residence for 30 days, and can be considered for extension.
3.2. Business visa
The second most popular type of visa is a business visa - business visa, or commercial visa. According to Document No. 27/VBHN-VPQH, this type of visa is divided into 2 subtypes, including:
- DN1 Visa - issued to foreigners working with businesses and other organizations with legal status according to Vietnamese law.
- DN2 Visa - issued to foreigners offering services, establishing a commercial presence, and performing other activities according to international treaties to which Vietnam is a member.
The maximum duration of a business visa is no more than 12 months.
3.3. Work visa
According to Document No. 27/VBHN-VPQH, work visas for foreigners in Vietnam are denoted as LD1 and LD2, and the maximum validity of the work visa is 2 years.
- LĐ1 visa - Issued to foreigners working in Vietnam with confirmation that they are not subject to a work permit, unless an international treaty to which Vietnam is a member has other provisions.
- Labor Visa 2 - Issued to foreigners working in Vietnam who require a work permit.
3.4. Electronic visa
Electronic visas are only valid for 30 days for foreigners who enter Vietnam once for tourism purposes, not for commercial or business purposes, and electronic visa holders can enter Vietnam via 1 of 37 regulated border gates.
According to the law, electronic visas are currently only issued to citizens in 80 countries according to regulations.

Question 1: When is a separate visa issued?

According to Consolidated Document 27/VBHN-VPQH, cases that are granted separate visas include:
(1) Passport has no visa page.

(1) Have diplomatic relations with Vietnam;
(2) Consistent with Vietnam's socio-economic development and foreign policy in each period;
(3) Do not harm Vietnam's national defense, security, social order and safety.
Thus, unilateral visa exemption for citizens of a country can only be implemented when all prescribed conditions are met.
Question 3: In what cases must documents proving the purpose of entry be required when applying for a visa?

According to Consolidated Document 27/VBHN-VPQH, the following cases requiring a visa must have documents proving the purpose of entry:
- Foreigners investing must have documents proving their investment in Vietnam according to the provisions of the Investment Law;
- Foreigners practicing law in Vietnam must have a practice license according to the provisions of the Law on Lawyers;
