On November 1, 2024, the Government issued Decree No. 143/2024/ND-CP regulating occupational accident insurance for workers who do not have labor contracts.

Freelance workers, such as street vendors, service workers, or seasonal laborers, typically do not have labor contracts and often lack access to social insurance or health insurance benefits. As a result, in the event of an occupational accident, these individuals not only face the burden of medical costs but also suffer significant income loss.
According to Decree 143/2024/ND-CP, individuals aged 15 and older who are not covered by mandatory social insurance for occupational accidents and diseases can participate in voluntary occupational accident insurance.
Upon participating in the insurance, workers are entitled to the following benefits:
1. Access to social insurance benefits as stipulated in Decree 143/2024/ND-CP.
2. Issuance and management of a social insurance book.
3. Timely receipt of voluntary occupational accident insurance benefits through one of the following payment methods:
- Directly from the social insurance agency or an authorized service organization;
- Through the worker's bank account.
4. Authorization for another person to receive voluntary occupational accident insurance benefits.
5. Information from the social insurance agency regarding contributions and benefits.
6. Government support for the payment of voluntary occupational accident insurance contributions as outlined in Decree 143/2024/ND-CP.
7. The right to file complaints, denunciations, and lawsuits regarding social insurance according to legal regulations.
Workers participating in voluntary occupational accident insurance are eligible for benefits if they meet the following conditions:
- Suffer a reduction in working capacity of 5% or more due to an occupational accident occurring during their insurance participation.
- Do not fall under the exclusions specified in Clause 2, Article 5 of Decree 143/2024/ND-CP.
Workers must register with the social insurance agency and can choose to pay contributions either every six months or annually. The voluntary occupational accident insurance contribution rates are as follows:
- For six-month contributions: 6% of the regional minimum wage IV.
- For annual contributions: 12% of the regional minimum wage IV.
Thus, workers without labor contracts should be well informed about their rights when participating in voluntary occupational accident insurance, as well as the relevant regulations regarding eligibility, payment methods, and contribution levels.
Decree 143/2024/ND-CP will take effect on January 1, 2025.
