PROCEDURES FOR CONSTRUCTING THE FIRST LAND PRICE LIST FOR PUBLICATION AND APPLICATION JANUARY 1, 2026

On September 25, 2025, the Ministry of Agriculture and Environment issued Decision 3969/QD-BNNMT in 2025 on promulgating newly issued internal administrative procedures; amending and supplementing the land sector under the scope of state management functions.

Pursuant to Section 1, Sub-section A, Section II, Part II of the Appendix issued with Decision 3969/QD-BNNMT in 2025, the procedures for developing the first land price list for publication and application from January 1, 2026 are as follows:

Step 1: The competent land management agency prepares a project to develop the land price list, which determines the content, time, progress, estimated implementation cost and related contents.

Step 2: The competent land management agency prepares the appraisal dossier for the land price list development project and sends it to the Department of Finance; the Department of Finance is responsible for appraising and sending the appraisal document for the land price list development project to the competent land management agency. The appraisal dossier for the land price list development project includes:

- Official letter requesting appraisal of the land price list development project;

- Draft Land price list development project;

- Draft Proposal for project approval;

- Draft Decision of the Provincial People's Committee on project approval.

Step 3: The competent land management agency receives and completes appraisal opinions and submits to the Provincial People's Committee the project dossier for land price list development. The project dossier for land price list development includes:

- Project for land price list development after receiving and completing appraisal opinions;

- Proposal for project approval;

- Draft Decision of the Provincial People's Committee on project approval;

- Document for appraisal of project dossier for land price list development.

Step 4: The Provincial People's Committee directs departments, branches, Commune People's Committees, Management Boards of high-tech parks and economic zones (if any) to develop land price lists.

Step 5: The provincial-level land management authority decides to place orders and assign tasks to a public service unit that is qualified to provide land price consultancy services or select a land price consultancy organization in accordance with the provisions of the law on bidding to develop a land price list.

Step 6: The Department of Finance submits to the Chairman of the Provincial People's Committee the composition of the Land Price List Appraisal Council as prescribed in Clause 1, Article 161 of the Land Law to appraise the draft land price list.

Step 7: The Department of Finance submits to the Chairman of the Land Price List Appraisal Council the decision to establish a Working Group to assist the Council.

Step 8: Organize the implementation of land valuation to develop a land price list:

- Investigate, survey, and collect information to serve the development of land price lists by area and location; the development of land price lists for each plot of land based on the value zone and standard plot of land;

- Determine land types, areas, and locations in each commune and ward for the area where the land price list is built by area and location; determine land types, total number of land plots, number of land plots of each type of land for the area where the land price list is built for each land plot based on the value zone and standard land plot;

- Synthesize and complete the records of investigation, survey, and information collection results at the commune and provincial levels; analyze and evaluate the results of the implementation of the current land price list for the construction of the land price list by area and location;

- Synthesize the results of investigation, survey, and information collection; establish the value zone; select the standard land plot and determine the price for the standard land plot; create a comparison ratio table for the construction of the land price list for each land plot based on the value zone and standard land plot;

- Develop a draft land price list and a draft explanatory report on the construction of the land price list.

Step 9: The competent land management agency shall:

- Prepare a draft Proposal on the issuance of the land price list;

- Post a dossier for collecting comments on the draft land price list on the electronic information page of the Provincial People's Committee and the competent land management agency within 30 days;

- Collect written comments on the draft land price list. Documents for collecting comments on the draft land price list:

+ Draft Proposal on the issuance of the land price list;

+ Draft land price list;

+ Draft Report explaining the development of the land price list.

- Receive and complete the draft Proposal on the issuance of the land price list;

- Direct the reception and explanation of comments, complete the draft land price list and the Report explaining the development of the land price list.

Step 10: The competent land management agency shall submit the land price list to the Land Price List Appraisal Council. The dossier for land price list appraisal includes:

- Submission on promulgation of land price list;

- Draft land price list;

- Report explaining the construction of land price list;

- Report on receiving and explaining comments on the draft land price list.

Step 11: The Land Price List Appraisal Council conducts the appraisal of the land price list and sends the appraisal document to the competent land management agency.

Step 12: The competent land management agency:

- Organizes the reception, explanation, revision and completion of the draft land price list according to the opinions of the Land Price List Appraisal Council.

- Submits to the Provincial People's Committee to submit to the Provincial People's Council for decision on the land price list. The dossier includes:

+ Submission on promulgation of land price list;

+ Draft land price list;

+ Report explaining the construction of land price list;

+ Report on receiving and explaining comments on the draft land price list;

+ Document of land price list appraisal;

+ Report on acceptance and explanation of opinions on land price list appraisal.

Step 13: Provincial People's Council decides on land price list.

Step 14: The competent land management agency publicly announces and directs updating to the national land database.

Step 15: Within 15 days from the date of decision to issue land price list; decision, adjustment, amendment, supplement to land price list, the Provincial People's Committee shall send the results to the Ministry of Agriculture and Environment according to Form No. 28 of Appendix II issued with Decree 151/2025/ND-CP.

Step 16: In case it is necessary to adjust, amend, supplement the land price list during the year, the Provincial People's Council shall decide to apply some or all of them according to the order prescribed in Section I, Part IV, Appendix I issued with Decree 151/2025/ND-CP.

The provincial-level land management agency submits to the provincial-level People's Committee to submit to the provincial-level People's Council for decision on adjusting, amending and supplementing the land price list.

In addition to the methods of determining land prices to build the land price list according to regulations, based on the actual situation in the locality, the land prices in the land price list of the area, location with similar infrastructure conditions to determine the land price to adjust, amend and supplement the land price list.

In the process of deciding on adjusting, amending and supplementing the land price list, if necessary, the provincial-level land management agency decides to place orders and assign tasks to qualified public service units to conduct land price determination consultancy activities or select a land price determination consultancy organization according to the provisions of the law on bidding to adjust, amend and supplement.
