On February 27, 2025, the Ministry of Public Security, the Supreme People’s Procuracy, and the Supreme People’s Court issued Joint Circular No. 02/2025/TTLT-BCA-VKSNDTC-TANDTC, which regulates coordination among competent authorities in criminal procedures, management, enforcement of temporary detention, custody, and execution of criminal judgments in the absence of district-level police organizations.

Accordingly, under the new structure, the investigative police agencies of the People’s Public Security force will comprise only: The Investigative Police Agency of the Ministry of Public Security and The Investigative Police Agency of the Provincial Police
The jurisdiction of the Investigative Police Agency of the Ministry of Public Security over the receipt and resolution of crime reports, prosecution, and investigation of criminal cases shall be exercised in accordance with the current legal regulations.
The jurisdiction of the Investigative Police Agency of the Provincial Police regarding the receipt and resolution of crime reports, prosecution, and investigation of criminal cases is specified under Clause 2, Article 5 of Joint Circular No. 02/2025/TTLT-BCA-VKSNDTC-TANDTC as follows:
- Receiving and handling crime reports, prosecution, and investigation of criminal cases concerning offences stipulated in Chapters XIV to XXIV of the Criminal Code, provided that such offences fall under the jurisdiction of the district-level People's Court, except for cases under the jurisdiction of the Investigative Agency of the Supreme People’s Procuracy and the Security Investigative Agency of the Public Security Forces.
- Receiving and handling crime reports, prosecution, and investigation of criminal cases related to the offences specified in Point a, Clause 2 of this Article when they occur across multiple districts, urban districts, towns, cities within a province, or centrally-governed cities, involving organized crime or foreign elements.
- Receiving and handling crime reports, prosecution, and investigation of criminal cases concerning the offences specified in Point a, Clause 2 of this Article when they fall under the jurisdiction of the provincial-level People's Court.
Important Note: The Investigative Police Agency of the Provincial Police shall take the lead in coordinating and supervising the district-level People’s Procuracy in performing preliminary verification of crime reports and denunciations received by Commune-level Police and Police Stations.
According to Clause 2, Article 6 of Joint Circular No. 02/2025/TTLT-BCA-VKSNDTC-TANDTC, the district-level People’s Procuracy shall have jurisdiction to exercise prosecutorial authority, control and supervise the reception, verification, and initial assessment of crime reports and denunciations, self-surrender, and confession cases handled by Commune-level Police and Police Stations; supervise the performance of duties and powers by Investigators and Investigation Officers assigned from the Provincial Investigative Police Agency to work at Commune-level Police and Police Stations; exercise jurisdiction as the competent procuracy where the crime was committed, if the crime occurs across multiple locations or the crime scene is undetermined, jurisdiction belongs to the People’s Procuracy of the district where the crime was discovered, where the suspect resides, or where the suspect was arrested.
The Provincial People’s Procuracy shall have jurisdiction to Exercise prosecutorial authority, control and supervise the reception, resolution of crime reports, prosecution, and investigation of criminal cases by the Investigative Police Agency of the Provincial Police; resolve, control and supervise the handling of complaints and denunciations related to the reception, resolution of crime reports, prosecution, and investigation of criminal cases undertaken by the Investigative Police Agency of the Provincial Police.
Thus, under Joint Circular No. 02/2025/TTLT-BCA-VKSNDTC-TANDTC, following the dissolution of district-level police agencies, significant adjustments have been made to the jurisdiction over criminal investigation, prosecution, and adjudication. Investigative Police Agencies will now operate only at the ministerial and provincial levels, while Commune-level Police and Police Stations will function under the supervision and guidance of higher authorities in handling and verifying crime reports and denunciations. The district and provincial-level People's Procuracies are also clearly assigned specific jurisdictional authority in prosecutorial supervision and investigative oversight. These structural changes are intended to enhance procedural efficiency, ensure transparency, and align with the new organizational framework of the People’s Public Security force.
Joint Circular No. 02/2025/TTLT-BCA-VKSNDTC-TANDTC takes effect on March 1, 2025.
