The Ministry of Industry and Trade has issued Official Telegram No. 2755/CĐ-BCT to reinforce market surveillance and inspection, and to strictly handle violations related to the production and trading of counterfeit goods, particularly counterfeit medicines and counterfeit health supplements.

In recent times, competent authorities have consecutively conducted inspections and uncovered a number of enterprises, organizations, and individuals involved in the production, advertising, and distribution of various types of counterfeit milk, counterfeit medicines, and counterfeit health supplements in several localities. Notably, these counterfeiting and trading activities have persisted over many years, directly endangering the health and lives of the public.
To enhance the responsibility of relevant authorities in managing, supervising, promptly detecting, preventing, and handling the production and trading of counterfeit goods, especially counterfeit milk, medicines, and health supplements; the Minister of Industry and Trade, who is also the Vice Head of the National Steering Committee 389, requests that the People’s Committees of provinces and centrally-governed cities implement the following directives:
- Closely monitor market developments and promptly consolidate and report to the Ministry of Industry and Trade on fluctuations in the market for essential goods serving production, business, and public consumption, particularly those items directly impacting human health.
- Direct functional agencies to promptly review and inspect compliance with the law by establishments trading in medicines and health supplements within their jurisdiction; recall counterfeit medicines and counterfeit health supplements that have been detected; and strictly handle violations in accordance with applicable laws.
- Strengthen inspection and supervision of food security and safety; resolutely combat, prevent, and strictly handle organizations, individuals, and establishments that violate food safety regulations. Promote the role of local authorities, regulatory agencies, social organizations, and consumer oversight in ensuring legal compliance on food safety among producers and business operators.
- Instruct relevant departments under the provincial People’s Committees to conduct post-market surveillance regarding self-declaration/registration of product declarations, production, trading, importation, advertisement, and sampling/testing of products and product groups listed in Appendix II of Government Decree No. 15/2018/NĐ-CP dated February 2, 2018.
Develop post-inspection plans for food production and trading establishments in the locality, focusing on food safety control and compliance with regulations on food safety in establishments that produce, trade, import, or advertise health supplements (via newspapers, broadcasting stations, and the internet); establishments producing medical nutrition foods and foods for special dietary uses; establishments producing, trading, importing, and advertising food supplements and formula nutrition products for infants. Direct relevant enforcement forces to enhance sampling and product quality testing during inspection missions.
- Increase inspection and strictly sanction acts of making false statements and misleading advertisements, particularly in relation to goods directly affecting public health.
- Strengthen dissemination, education, and awareness-raising efforts to identify responsibilities and actions of Party Committees, organizations, officials, Party members, and the public in ensuring food security and safety; promote the roles and responsibilities of organizations, individuals, and businesses in implementing the law on food safety; promptly provide information about safe and high-quality agricultural and food supply chains, as well as violative establishments or those posing food safety risks.
Thus, The issuance of Official Telegram No. 2755/CĐ-BCT by the Ministry of Industry and Trade demonstrates a strong determination of the regulatory authority to tighten market inspection and strictly handle violations, particularly false statements and misleading advertisements concerning products that directly affect public health such as medicines, milk, and health supplements. This is a necessary move to protect consumer rights, ensure food safety, and reinforce the responsibilities of competent authorities, businesses, and the broader society in the fight against counterfeit and substandard products. Localities, especially major urban areas such as Hanoi, must urgently and comprehensively implement the measures outlined in the directive to contribute to market stability, protect public health, and strengthen public confidence in state management.
