On May 15, 2024, the Ministry of Justice issued Decision 854/QD-BTP in 2024 announcing amended and supplemented administrative procedures in the field of property auction. In particular, the procedure for registering the operation of a branch of a property auction enterprise is specified in the 6th administrative procedure, part B - Provincial administrative procedures, Appendix issued together with Decision 854/QD-BTP in 2024.

According to Decision 854/QD-BTP in 2024, the procedures for registering the operation of a branch of a property auction enterprise are prescribed as follows:
(1) Dossier of establishment of a branch of the property auction business
- An application for operation registration of the branch according to Form TP-DGTS-09 issued together with Circular 03/2024/TT-BTP;
- Decision on establishment of the branch;
- A certified copy or a copy enclosed with the original for comparison of the enterprise's operation registration certificate;
- A certified copy or a copy enclosed with the original for comparison of the auction practice certificate of the head of the branch;
- Documents proving the head office of the branch.
Number of dossiers: 01 set.
(2) Place of application
The Department of Justice of the locality where the enterprise locates its branch.
(3) Implementation order
Branches of property auction enterprises are established inside or outside the provinces or centrally-run cities where the property auction enterprises register their operations. The auction enterprise shall register the operation of the enterprise's branch to the provincial-level Justice Department of the locality where the branch is located.
(4) How to do it
The dossier shall be sent directly, via the postal system or online (if the administrative procedures have been provided online) to the Department of Justice.
(5) Time limit for settlement
Within 07 working days from the date of receipt of a complete and valid dossier, the provincial-level Justice Department shall issue an operation registration certificate to the branch; in case of refusal, the reason must be notified in writing. Rejected enterprises have the right to complain and initiate lawsuits in accordance with law.
(6) Agencies carrying out administrative procedures
The Department of Justice is the agency that carries out administrative procedures.
(7) Results of implementation of administrative procedures
Decision on operation registration of the branch of the property auction enterprise.
(8) Fees and charges
No regulation.
(9) Requirements and conditions for carrying out administrative procedures
The property auction enterprise shall appoint an auctioneer of the enterprise to be the head of the branch.
Thus, from May 15, 2024, the procedures for registering the operation of the branch of the property auction enterprise shall be carried out in accordance with Decision 854/QD-BTP in 2024.
Decision 854/QD-BTP in 2024 takes effect from May 15, 2024.
